The San Francisco Chronicle pointed out the pink elephant in the room in the Prop 8 case. Chief U.S. District Judge Vaughn Walker HIMSELF is gay. Before we start hurling rocks or waving "hurray the judge is gay" signs let's remember that the case hasn't been decided yet.The Judge would not comment to the SF Chronicle if his orientation is at all relevant to the lawsuit. He did take on another gay rights case when he was a private attorney. He represented the U.S.Committee in a successful bid to keep San Francisco's Gay Olympics from infringing on its name.Judge Walkers comments to the SFChronicle at that time were as follows:"Life is full of irony," the judge replied when we reminded him aboutthat episode.And did he have any concerns about being characterized as gay?"No comment."Shortly speaking to the SF Chronicle they heard from a federal judge who counts himself as a friend and confidant of Walker's. He said he had spoken with Walker and was concerned that "people will come to the conclusion that (Walker) wants to conceal his sexuality.""He has a private life and he doesn't conceal it, but doesn't think it is relevant to his decisions in any case, and he doesn't bring it to bear in any decisions," said the judge, who asked not to be identified because of the sensitive nature of the Prop. 8 trial."Is it newsworthy?" he said of Walker's orientation, and laughed. "Yes."It seems that the giant pink elephant in the room is nether good nor bad. We want to believe the judicial system actually works because how could it NOT be our constitutional right to marry? If you really separate Church and State The Constitution is pretty clear. Nowhere did it exclude the LGBT community when they wrote "We the People..."
